Maximum 5 years in jail for MLM fraud

Dhaka, Sep 17 (bdnews24.com)—The Cabinet on Monday endorsed in principle the ‘Multi-Level Marketing Control Act-2012′ draft incorporating provisions of a maximum of five-year jail term and fine for cheating and doing business without licence.

The nod came at a regular meeting chaired by Prime Minister Sheikh Hasina.

Cabinet Secretary Md Mosharraf Hossain Bhuiyan briefed journalists after the meeting.

The punishment for running a business without licence has set at three to five years’ imprisonment along with Tk 5 million in fine.

If a company (MLM) cheats through false advertisements, it would attract a maximum of five-year jail term. The company will also have to pay back double the amount to the deceived, the draft said.

Bhuiyan said the Cabinet had endorsed the draft changing its name to ‘Multi-Level Marketing Control Act-2012’ from ‘Direct Sell Act 2012’.

The Secretary said any MLM company selling its products at exorbitant prices would get punitive measures from six months to one-year jail term and Tk 50,000 in fine.

The draft will now be sent to the law ministry for scrutiny. It will be then presented before the Cabinet again for its final approval, he added.
